Welcome to Nevuto! By creating a Nevuto Account or utilizing any Nevuto Services, you signify your consent to be governed by the subsequent terms and conditions (the "Terms of Service").

Nevuto is an ecommerce platform headquartered in Albuquerque, New Mexico, United States. Our platform offers a comprehensive commerce solution, empowering Online Sellers to streamline and enhance their online business operations.

1. Account Terms

  1. To access and utilize the services provided by Nevuto, you must create a Nevuto account. You are required to furnish us with accurate and complete information, including your full legal name, business address, phone number, a valid email address, and any other details indicated as necessary.
  2. To open an Account, you must be either at least 18 years old, or the age of majority in your jurisdiction of residence.
  3. You confirm that your usage of Nevuto's Services is for business purposes and not for personal, household, or family use.
  4. The email address you provide during Account creation will serve as the primary method of communication between you and Nevuto.
  5. Safeguarding your password is your responsibility. Nevuto cannot be held liable for any loss or damage resulting from your failure to maintain the security of your Account and password.
  6. Technical support is exclusively available to registered users.
  7. You agree not to reproduce, duplicate, sell, resell, copy, or exploit any part of the platform without prior written consent from Nevuto.
  8. You agree not to attempt to circumvent any technical limitations of Nevuto's Services.
  9. Automated access to Nevuto's Services through robots, spiders, scrapers, or other similar means is prohibited.
  10. You acknowledge that your materials may be transmitted in an unencrypted manner and might undergo changes to adapt to technical requirements during transmission.

2. Account Activation

2.1 Store Owner

The person who initiates the registration process will become the primary contracting party ("Store Owner"). The Store Owner's name must be prominently displayed on the Store's website. Each Nevuto Store can be linked to a single Store Owner, but a Store Owner can oversee multiple Nevuto Stores.

2.2 Staff Accounts

According to your Nevuto pricing plan, you have the capacity to create one or more staff accounts that grant access to other individuals within the Account. The Store Owner assumes responsibility for ensuring that their employees adhere to these Terms of Service.

2.3 Nevuto Checkout

Upon successful completion of Service registration, Nevuto will generate a Nevuto Checkout account. Cash on Delivery will serve as your default payment method.

3. Nevuto Rights

The Nevuto Services encompass a spectrum of features and functionalities. Not all Services or features will be universally accessible to all Store Owners. We retain the authority to alter the Services or any segment thereof for any reason, at any time, and without prior notice.

Any form of verbal or written abuse directed toward any Nevuto employee will result in immediate termination of your Account.

4. Your Responsibilities

You will provide readily accessible contact information, a clear refund policy, and defined order fulfillment schedules on your Nevuto Store. You bear the status of the seller for all items sold through the Services and are accountable for establishing and managing your store, materials, and all elements of transactions.

5. Customer Information

You are obligated to adhere to all pertinent privacy and data security laws and regulations. You must maintain the privacy and security of all customer information collected through the Services and notify customers about how their personal data is collected, used, and shared.

6. Proprietary Rights

Nevuto retains ownership of all intellectual property rights in and to the Services. You retain ownership of all intellectual property rights in your Materials. By submitting Materials through the Services, you grant Nevuto a non-exclusive, royalty-free, worldwide license to use them solely for the purpose of providing the Services.

7. Payment of Fees

By selecting a pricing plan and providing payment information, you agree to pay all applicable fees and charges. All fees are exclusive of applicable taxes, levies, or duties imposed by taxing authorities.

8. Limitation of Liability

Nevuto shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from the use or inability to use the Services, unauthorized access to your data, or any other matter relating to the Services.

9. Indemnification

You agree to indemnify and hold Nevuto harmless from any claim or demand made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

10. Termination

Nevuto may terminate your Account and access to the Services at any time and for any reason. Upon termination, your right to use the Services will immediately cease.

11. Governing Law and Jurisdiction

These Terms of Service shall be governed by the laws of the State of Delaware. Any legal action shall be brought exclusively in a federal or state court sitting in the State of Delaware, County of New Castle.

12. Changes to Terms of Service

Nevuto reserves the right to update, change, or replace any part of these Terms of Service. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.
